Tips are in addition to wages; break timing must not be used to shift wage obligations onto tip income. -------------------------------------------------------------------------------- SECTION 3: MEAL PERIOD REQUIREMENTS (WAGE ORDER 5) -------------------------------------------------------------------------------- 3.1 First Meal Period: Employees who work more than five (5) hours in a shift are entitled to an unpaid, duty-free meal period of at least thirty (30) consecutive minutes, beginning no later than the end of the fifth hour of work — unless a lawful written waiver applies (see Section 3.4). 3.2 Second Meal Period: Employees who work more than ten (10) hours in a shift are entitled to a second unpaid, duty-free meal period of at least thirty (30) consecutive minutes, beginning no later than the end of the tenth hour of work — unless a lawful written waiver applies. 3.3 Duty-Free Standard: During a meal period, employees must be: * Relieved of all duties (including answering POS, seating guests, expo, or radio calls) * Free to leave the premises * Uninterrupted for the full meal window If the employer requires the employee to remain on premises or on-call, the meal period is generally treated as on-duty and must be paid (on-duty meal agreements require a written agreement meeting Wage Order conditions and are limited to roles where the nature of work prevents relief). 3.4 Meal Period Waivers (When Permitted): * First meal may be waived by mutual written consent only if the total shift is no more than six (6) hours. * Second meal may be waived by mutual written consent only if the total shift is no more than twelve (12) hours and the first meal was taken. * Waivers must be voluntary, in writing, and revocable by the employee at any time. -------------------------------------------------------------------------------- SECTION 4: REST BREAK REQUIREMENTS -------------------------------------------------------------------------------- 4.1 Paid Rest Breaks: Employees are authorized and permitted a paid net ten (10) minute rest break for every four (4) hours worked (or major fraction thereof). Rest breaks are paid continuous time and employees must remain relieved of duties. 4.2 Practical Scheduling Guide (Common Restaurant Shifts): * Shifts from 3.5 up to 6 hours: generally 1 paid rest break * Shifts from 6 up to 10 hours: generally 2 paid rest breaks * Shifts from 10 up to 14 hours: generally 3 paid rest breaks (Exact application follows Wage Order timing; MODs schedule rest breaks near the middle of each four-hour work period when practicable.) 4.3 Rest Break Rules: * Rest breaks may not be combined with meal periods to shorten the overall break obligation. * Employees must not be required to remain "on radio" or cover tables during rest breaks. * Missed rest breaks trigger premium pay (Section 5). -------------------------------------------------------------------------------- SECTION 5: PREMIUM PAY FOR NON-COMPLIANT BREAKS -------------------------------------------------------------------------------- 5.1 One-Hour Premium (Labor Code § 226.7): If an employee is not provided a required meal or rest break, the employer owes one additional hour of pay at the employee's regular rate of compensation for each workday a meal period is non-compliant, and one additional hour of pay for each workday a rest period is non-compliant. 5.2 Manager Logging Duty: When a break is late, short, interrupted, or missed, the MOD must: 1. Record the date, shift, employee name, break type, and reason. 2. Ensure premium pay is coded in payroll for that workday. 3. Correct scheduling practices before the next shift pattern repeats. 5.3 Regular Rate Note: Premium pay is calculated using the employee's regular rate (including applicable non-discretionary pay elements required by law). Payroll administrators should verify calculation method with counsel or a qualified payroll provider. -------------------------------------------------------------------------------- SECTION 6: SCHEDULING PRACTICES FOR RESTAURANT OPERATIONS -------------------------------------------------------------------------------- 6.1 Pre-Shift / Line-Up Expectations: MODs assign meal and rest windows during pre-shift line-up and update them when covers, call-outs, or 86'd stations change the floor plan. 6.2 Busy-Service Protocol: High cover counts do not suspend California break law. If service volume threatens break timing, the MOD must: * Rotate relief coverage * Call in additional support when available * Document and premium-pay any unavoidable non-compliant break the same workday 6.3 Multi-Unit Consistency: Each operating unit maintains its own break logs and acknowledgments.
